DMCA Policy

We do not host the content in this archive - we relay it. We still act on valid notices, and this page says exactly how.

1. Our role

The videos and images here are relayed from the public feed of redgifs.com. The master copies are held by the original producers and by that platform; this site holds a copy for display and nothing else.

We do not upload, curate or licence the material, and we do not claim any right to it. What we can do about a notice is stop showing the material here - which is what we do.

2. Designated agent

Copyright notices for this site go to abuse@xredgifs.com, the address the operator of xredgifs.com uses as its designated agent for copyright matters. A postal address is provided on request to the same address.

3. Sending a notice

Send a written notice to abuse@xredgifs.com with the subject "DMCA notice", including:

• a physical or electronic signature of the copyright owner or of a person authorised to act for them;

• identification of the copyrighted work you say is infringed (a title, a link to it, or a copy);

• the exact URL on xredgifs.com of each item you want removed, enough for us to find it without guessing;

• your name, postal address, telephone number and e-mail address;

• a statement that you believe in good faith that the use is not authorised by the copyright owner, its agent or the law;

• a statement, under penalty of perjury, that the information in the notice is accurate and that you are the owner or are authorised to act for them.

4. What happens next

We check that the notice is complete and that the URL exists. If it is, we hide the post: it disappears from listings, tag pages, search and the sitemap at the next build, which runs automatically, and we reply to the address the notice came from.

An incomplete notice is returned with a note saying what is missing, so a genuine claim is not lost to a formality.

We keep a record of every notice and of what was done about it.

5. Counter-notice

If material of yours was hidden and you believe that was a mistake or a misidentification, write to abuse@xredgifs.com with:

• your physical or electronic signature;

• the URL that was removed and a description of the material;

• your name, address, telephone number and e-mail address;

• a statement that you consent to the jurisdiction of the courts where you live (or, if you live outside the country in which the operator of xredgifs.com is established, of that country's courts), and that you will accept service of process from the person who sent the original notice;

• a statement, under penalty of perjury, that the material was removed by mistake or misidentification.

We pass the counter-notice to the person who complained. Unless they tell us they have started proceedings, we may restore the post after 10 to 14 days. Because this archive is a copy of a feed, restoring a post here restores nothing on the source platform.

6. Repeat notices

We record notices against the creators and posts they concern. A creator whose material repeatedly draws valid notices is removed from the archive's tracking list, after which nothing of theirs is fetched again, and their existing posts are hidden. This site has no accounts, so there is no account to terminate.

7. False notices

A false notice harms a real creator and can be costly: section 512(f) of the DMCA allows liability for a knowing material misrepresentation, and a counter-notice is the remedy we offer. If we find a notice to be one, we will say so in public.

8. Fair use and other defences

Nothing in this policy stops a creator, or anyone else, from relying on fair use or another lawful defence. We act on notices, we do not adjudicate copyright.
